The following text is an excerpt of former USA Swimming president (and still ex officio board member) Dale Neuburger’s January 7, 2011, deposition in the lawsuit by “Jane Doe” – a sexual abuse victim of now-imprisoned coach Andy King – against USA Swimming.

“Mr. Little” is plaintiff attorney Jonathan Little. “Ms. Weil” is defense attorney Jean A. Weil.

As of today, Concussion Inc.’s Freedom of Information Act request to the Department of Homeland Security for the visa file of George Gibney is listed as No. 124 on the “complex track” queue at U.S. Citizenship and Immigration Services. Our request is being assisted by Senator Dianne Feinstein and Congresswoman Jackie Speier.

 

What about if he was charged with 17 counts of rape and sodomy of various young boys going back to say, the late sixties, would knowledge of that warrant an investigation?

WEIL: Same objection, overbroad, lacks foundation, incomplete hypothetical.

A. Yes.

BY MR. LITTLE:

What if, instead of a board member, it was a coach in USA Swimming?

WEIL: Same objections.

A. Would you repeat the question.

BY MR. LITTLE:

I’m saying if there was a coach in USA Swimming who was arrested and charged with dozens of counts of sodomy and rape against 17 young boys and girls dating back in 1968, and he was in USA Swimming coaching, would knowledge of those arrests warrant an investigation of that coach?

A. Yes.

Do you know who George Gibney is?

A. No, I indicated I don’t know George Gibney.

The situation I just explained with a coach who had those charges against him, sodomy and rape and dozens of counts, would USA Swimming write a letter of support for his visa application to the United States?

WEIL: Objection, lacks foundation, calls for speculation, incomplete hypothetical.

LITTLE: You know what, we’ll change would to should.

WEIL: Same objections.

LITTLE: That’s fine.

WEIL: And argumentative, to boot.

A. A visa application for a foreign coach to enter the United States? If you could clarify the question for me, if you’ve asked about a visa application.

 

BY MR. LITTLE:

If George Gibney was charged with the rape and sodomy situation I just explained to you, which he was in Ireland, why would USA Swimming write a letter in support of his visa application?

WEIL: Objection, assumes facts not in evidence, lacks foundation, incomplete hypothetical, argumentative.

 

BY MR. LITTLE:

Okay, I’m going to actually go with that. Did USA Swimming write a letter in support of his visa application?

A. I don’t know.

When were you president of USA Swimming?

A. October 2nd, 1998, to September 14th, 2002.

Do you know if ASCA [American Swimming Coaches Association] wrote a letter in support of his visa application?

I do not know.
